Minutes
The meeting was called to order at 10:04am at Harvey Michaels home at 11711 Beachside Drive in Beachside Village. Due to the size of the crowd, the meeting was moved to the ground level for COVID reasons. Board members in attendance were Bob Aubrey, Bruce Bardwell, Rick Burke, Harvey Michaels, Kim Reuse, Fred Wagner and Ben Westcott. Also in attendance were Debbie Reinhart, Bruce Reinhart and Austin Reinhart. There were 25 property owners representing 18 properties at the meeting. There was a quorum.
The Board reviewed the minutes from the April meeting. Bruce Bardwell moved to approve the minutes and Bob Aubrey seconded the motion. The minutes were approved.
Marie Robb
Marie is the City Councilwoman for the west end. She was unable to attend the meeting but provided the following report that was read on her behalf:
“Update: Things continue to move forward on the beach design and engineering Beach project from 7 mile to 13 mile road. Congressman Weber is in the process of setting up a meeting with Col. Rhett Blackmon, the new corps Colonel for the city team to assist in moving the beneficial use of dredge project to the west end beaches. Randy has agreed to attend all meetings with the Corps of Engineers. Tuesday I will be attending the TWIA board meeting to speak in favor of no rate hike. The city is in the budget process and the goal is to keep the tax rate as low as possible. Utility hardening continues.”
Financial Reports
The financial statements and cash accounts were reviewed. Rick Burke moved to approve the financial statements and cash accounts and Bruce Bardwell seconded the motion. The financials were approved.
Old Business:
Dune Repair Project
Debbie reported that the dune repair project was complete. The total cost of the project was just over $256,000 and all of the Special Assessment had been collected except for $2750. Debbie is working on collecting the Assessment from those who are delinquent.
Rental Registration and Compliance
Debbie reported that there are 49 short term rentals in Beachside Village. All rental registration fees have been paid. Debbie shared a list of rental regulation violation notices that have been sent to owners this year. Only one of the properties had a duplicate violation that prompted a fine and a fine letter has been sent to that owner. The board instructed Debbie to have the HOA attorney send a collection letter to the owner to collet the $500 fine for the second offense. Debbie also reported that there were 7 rental properties that were advertising occupancy limits that exceeded the occupancy limit for the home. Debbie sent violation letters to all 7 of those owners.
Splash Day
Debbie reported that Splash Day seemed to be a huge success! Pappas Catering served 205 plates of food and the sno-cone vender reported making 110 sno-cones!
New Business:
The board has met with and retained a new attorney who is a community association specialist. The board intends to keep the previously scheduled quarterly board meetings and to also hold monthly meetings during which the board can become more familiar with the scope of work currently being managed by the property managers and to add additional rules and regulations as the board sees fit. The new HOA attorney has approved this process and has given the board a list of actions the board cannot take during these meetings (reference Texas Property Code 209.0051) The attorney will work with the board and the property manager to assure that the HOA is in compliance with Texas HOA regulations that change from time to time. The developers agreed to allow the board to review any future changes to the existing plat in the future. Bruce Reinhart explained that wetland management must be done carefully and that wetlands cannot be filled but they can be mowed. The board is creating builder regulations with enforcement as the neighborhood has an increasing number of construction projects. The board asked Debbie to have the HOA attorney send another warning letter to the owner who continues to bring his boat into the neighborhood which is against the neighborhood deed restrictions. Lastly, an owner of a rental property asked to speak to the board about a violation letter she received stating that her current property manager (her daughter who lives off-island) was unavailable to manage a problem with her home. The board asked the owner to find a local management company which is required by the rental regulations.
It was reported that Rick Burke has stepped down as President of the Board and he will remain on the Board. Ben Westcott will be the Board President and Harvey Michaels and Fred Wagner will serve as co-vice presidents.
The meeting was adjourned at 11:45.
