Minutes
The meeting was called to order at 10:07. The meeting was held at Harvey Michael’s house in Beachside Village – 11711 Beachside. In attendance were Harvey Michaels, Bruce Bardwell, Gary Barber, Fred Wagner, Rick Burke, John Price and Kim Reuse. Also in attendance was Debbie Reinhart, Bruce Reinhart and Austin Reinhart. The HOA attorney, Steve Schulz and City Councilwoman Marie Robb were also in attendance. Our security officer, Craig Dickey was also in attendance. There was a quorum.
The Board reviewed the minutes from the April meeting. Bruce Bardwell moved to approve the minutes and Gary Barber seconded the motion. The minutes were approved. The financial statements and cash accounts were also reviewed. John Price moved to approve the financial statements and cash accounts and Rick Burke seconded the motion. The financials were approved. Debbie explained that a new budget category was on the current financial statements – Quickbooks Payment Fee – which is a new assessment by Intuit for those owners who are paying using the Intuit payment process. She also explained that some of the expense categories were artificially low on this report because she and Bruce were away for the last half of June and several invoices from the second quarter hadn’t been paid in June. They will be paid in July. Lastly, Debbie explained that the security budget category will possibly be over budget by approximately $5000 to accommodate the security schedule and the additional cost of the enhanced license plate reader.
Marie Robb
Debbie thanked Marie for getting the additional port-a-cans at the 8 Mile Road which should help with beach goers coming into Beachside Village looking for restrooms. She also thanked Marie for all of her efforts during the freeze in February. Marie reported on the following:
- The IDC recently agreed to extend the design phase of the beach renourishment from the 8 Mile Road to the 13 Mile Road. The Texas General Land Office has agreed in principle that In order to install a fortified dune it must be 200’ from the shore. She stated that there is sufficient sand source to extend the renourishment. Through several intergovernmental relationships, she thinks this can be achieved every couple of years.
- At the city level, short term rentals are being required to have a license number and that number must be listed in any advertising. There is also a registration fee that needs to be paid. The city has 5-6 full time Marshalls that can evict renters, if necessary. She stated that Beachbox currently has 67 properties under management. She said that there aren’t any statewide rental guidelines and that several neighborhoods have banned rentals all together. She stated that the city can try to regulate capacity by requiring a parking plan – she’s referring here to neighborhoods in town where parking is challenging. She suggested that we change our rental regulations limiting the number of renters by the number of bedrooms.
- Golf carts are a big topic at City Hall. Marie is trying to get the city to differentiate between the golf carts used in west end neighborhoods from those rented in town and along the Seawall.
- Marie reported that the construction to raise FM3005 was moving along and then the state needed to remove some of the asphalt because it was of poor quality.
- Marie stated that her goal is to get all of the on-beach parking removed and placed in beach pocket parks along the west end. She hopes to have the parking lot at the Tipsy Turtle enlarged and to get parks 3 & 4 reopened.

Craig Dickey – Security Report
Craig created a pie chart showing the number and types of incidents he responds to during the quarter. He will create one showing zones (or areas within Beachside Village) that explains who he is in contact with: owners, renters, contractor or general public. His hours in the neighborhood are typically Friday from 2-10pm and Saturdays & Sundays from 10-10pm. Debbie thanked him for his efforts.
Old Business:
Storm Damage
Debbie reported that she received the permit from the city (and state) to repair the dunes in mid-May. At that time, she coordinated the sand source, the trucking company to deliver the sand to Beachside Village and the contractor who will make the repairs to the dune walkovers. The work to repair the dune walkovers has been completed. The next phase will be to build the new dune and then to repair/install the sand fence. The board decided to make the Special Assessment once we start bringing in the sand rebuild the dunes.
Short Term Rentals
With the ongoing conversation and concerns about the Beachbox (green monster & it’s sister rental) rentals in Beachside Village and with the fact that entity has solicited current homeowners in an interest to purchase additional homes in Beachside Village, the board had asked Steve Schulz, at the April meeting, to look into the possibility of whether or not an entity like Beachbox could be considered a ‘commercial business’ and therefore its function in Beachside Village would be a violation of the Beachside Village Declaration of Covenants. Steve had previously presented a memo prepared by one of his associates that addressed a similar case and explained that the Board would need to accumulate much more information before he would be able to recommend pursuing legal action against Beachbox on these grounds. Upon further research prior to the meeting he found that case law is slim and would be difficult to pursue additional regulations without the benefit of a change to the deed restrictions that would better define “commercial business”. The board also discussed the possibility of limiting the occupancy of rental houses. Steve said he would look into this.
New Business:
Debbie reported that there continue to be a couple of owners who consistently bring their boats to the neighborhood which is against the deed restrictions. When this happens repeatedly, Debbie has Steve write them a letter reminding them of the deed restriction violation and this typically reduces future violations. Bruce reported that he had recently looked into hiring a contractor to help with mosquito control. Several owners have complained that with all of the rain in the spring and early summer, there were a lot of mosquitos in the ditches and greenbelts. Bruce contacted Truly Nolen which provided a proposal to treat the streets, ditches, greenbelts and vacant lots twice each month for $43,000/year. After discussion, Rick Burke made a motion to approve the proposal and Harvey Michaels seconded the motion. The motion was approved.
There being no other business, the meeting was adjourned.
