Minutes
The meeting was called to order at 10:07. The meeting was held at the Reinhart’s house in Beachside Village – 3815 Periwinkle. In attendance were Harvey Michaels, Bruce Bardwell, Gary Barber, Fred Wagner, Al Browning, Rick Burke, and Kim Reuse. Also in attendance were Bruce, Debbie and Austin Reinhart. Our security officer, Craig Dickey and Steve Schulz, HOA attorney were also in attendance. There was a quorum.
The Board reviewed the minutes from the October meeting. Rick Burke moved to approve the minutes and Bruce Bardwell seconded the motion. The minutes were approved. The financial statements for the 4th quarter were also reviewed. Concerning the financial statements, Debbie reported that the only budget category that was very out of budget was the Beach and Dune expenses. The budget for 2019 was $25,000 and included in that amount was the anticipated cost to remove/replace the 5 mat style walkovers – at the time the budget was prepared, there was not going to be any beach raking so there was no money allocated for that expense. Debbie actually spent $66,400 in beach and dune expenses. She reported that she paid $10,000 to the Galveston Parks Board as a retainer for beach cleaning during a major seaweed inundation, $20,000 to remove/replace the 5 mat style walkovers, $11,000 to remove all of the old sand fence material between the two dunes and remove/replace the sand fence at the north toe of the dunes on the undeveloped lots, $3,000 for dune walkover repair caused by the tropical storm and almost $22,000 in beach raking costs. Harvey Michaels moved to approve the financial statements and Gary Barber seconded the motion. After reviewing the 2019 Budget vs. Actual, Debbie presented the proposed 2020 Budget for discussion. Harvey Michaels moved to approve the 2020 Budget and Al Browning seconded the motion.
Old Business:
Short Term Rentals
Debbie reminded the board that there were two questions left from the prior meeting that needed final discussion and attorney support. The first was the question of whether or not it was legal for Debbie to report evictions to the owners and the second was what were the options if a property manager was not available 24/7? Steve agreed that we could notify owners of evictions and presented some information about the City of Galveston short term regulations that should be incorporated into our rental regulations. Steve agreed to review this and propose the revision. Debbie handed out email communication from Harrison Yat concerning fines levied against his property. The fines totaled $1600 and Harrison asked to negotiate the fine to $800. The board discussed this and decided that it was not a good idea to negotiate for fines and asked Debbie to respond as such to Harrison. The board asked Debbie to monitor all rentals weekly, reviewing the security reports and assess fines each week as necessary. Steve Schulz was asked what the board could do if the fines weren’t paid and Steve suggested that if they weren’t paid within 30 days he will file a lien on the property.
Town Architect Audit
Debbie reported that all owners were now compliant with their TA Audit report issues. The board requested that the Town Architect audit the next 25 homes this fall. Last year the TA audited the 25 oldest homes and now will audit the next 25. Bruce, Debbie and Austin will evaluate each home in the neighborhood for night lighting compliance. They will report their findings to the TA who will then include that information in his audit.
Beach Cleaning Update
The City of Galveston extended all neighborhood beach cleaning permits until the end of December 2019. The beach cleaning permit in Beachside Village should have expired in August 2019 but was extended with all others. Debbie is in the process of applying for the 2020 permit.
City of Galveston/GLO parking concerns
Debbie reported that she received a letter from the City in November asking for a meeting to discuss public beach access parking within Beachside Village. Bruce and Debbie met with the Director of Planning and the Coastal Director on December 18th. The City asked whether or not there were the required spaces along Sea Butterfly as stated on the plat and Debbie explained to the City that it was the City who put that information on the plat. After much discussion, the Director of Planning will study the neighborhood some more and find the necessary number of parking spaces. It was unclear how those spaces would be identified and/or marked but Debbie reminded the Director that all streets in Beachside Village were public and that there were quite a few possibilities to account for that many parked cars. Debbie requested that while the Director was working on this that he consider moving all parking off of Beachside Drive for safety reasons. Debbie also reported to the Director that the owners in Beachside Village were very disappointed with the City and it’s lack of support against the GLO’s requirement that the night time security gate be removed.
Walkovers in Sections 4 & 5
Debbie reported that she had finally gotten the permit to construct the two mat style walkovers in Sections 4 & 5 and that the work in currently underway.
New Business:
At the request of the Board, Steve Schulz wrote a letter to the Hyden’s who live on Starfish and reminded them that boat storage must either occur under their home and screened from view or that it be moved off premises. The boat was removed a short time later.
General Discussion:
There was quite a bit of general discussion after the old and new businesses were discussed. Some of this discussion occurred during the old and new business but is reported here. Several owners reported that their trash cans weren’t always put back under their houses after the trash was picked up. Debbie will contact the contractor that performs this work and ask him about this. She will also schedule him to repaint the red stripe along Beachside Drive. Rick Burke asked about the landscaped areas at the dune walkovers. Debbie explained that work is done when houses have been built on both adjacent properties. She reported that she will build one between Lots 134 & 135 as soon as the house on Lot 134 is completed. Rick asked about the walkover between Lots 139 & 140. Debbie will verify that the owner of Lot 139 doesn’t intend to build and if so, she can work on that walkover, as well. There continues to be general issues with drainage and the board asked if someone from the City could attend the next board meeting to discuss drainage in the neighborhood. Rick suggested that we have security coverage over Thanksgiving weekend, Christmas and New Year’s Eve. Debbie will arrange this. Harvey suggested that we get some pricing for extended security coverage and make this information available at the annual meeting for discussion. Harvey also suggested that we increase the neighborhood security budget amount to $45,000 to accommodate additional security as needed. Gary asked why the bollards segregating the on-beach parking from Beachside Village looked so bad. Bruce reported that he has offered to the City to replace and maintain those bollards but the City hasn’t allowed it. Debbie will ask the president of the Sunny Beach neighborhood why their bollards are so well maintained. Rick asked Steve Schulz to find out whether or not owners with rental properties were required by the City to have specific insurance on their properties. If so, he suggested that we make sure the owners are providing us with that information. Lastly, Rick suggested after the meeting that Debbie try to get a speaker at the annual meeting to discuss windstorm insurance that is NOT sold through TWIA. Debbie will work on that.
