Minutes
The meeting was called to order at 10:10. The meeting was held at the Reinhart’s house in Beachside Village – 3815 Periwinkle. In attendance were Harvey Michaels, Bruce Bardwell, Gary Barber and Fred Wagner, Al Browning, Rick Burke, John Price and Kim Reuse. Also in attendance were Bruce, Debbie and Austin Reinhart. Our security officer, Craig Dickey and the owner of FCP Security, Jason Buie were also in attendance. There was a quorum.
The Board reviewed the minutes from the July meeting. Bruce Bardwell moved to approve the minutes and Al Browning seconded the motion. The minutes were approved. The financial statements for the 3rd quarter were also reviewed. Fred Wagner moved to approve the financial statements and Gary Barber seconded the motion.
Old Business:
Security Gate/GLO/City of Galveston – As required by the City of Galveston, the security gates were removed on October 14, 2019.
Short Term Rentals
Debbie reported that Steve Schulz has been reviewing the state property code and looking at other neighborhoods and municipalities as possible templates for our neighborhood. Steve will report his findings at the next meeting. Steve said that this is the hottest topic in municipal law these days. There was discussion about whether or not Debbie should report evictions to the property owners and the Board agreed that she should. She will get with Steve Schulz and discuss making a change to our Rental Regulation document. Harrison Yat, one of the owners of the rental house located at 11610 Beachside was in attendance at the request of the Board of Directors. This home is by far the largest problem of all of the short-term rentals in Beachside Village. After much discussion, Harrison stated that he had misunderstood the regulations and that now he had a better understanding of which regulations apply to owners and which apply to renters. He felt that he and his partner were being singled out but realized what would be needed from him as an owner going forward. During the conversation, Al Browning suggested that Debbie get a copy of each rental owners rental agreement in an attempt to be assured that owners are actually giving their renters the regulations so that the renters can comply. Debbie will work on this in early 2020. It was agreed that rental companies must respond 24/7 and that it’s not acceptable if rental company or rental contact is not available. If a management company are not fulfilling its responsibility it can be removed as an management company. Lastly, Debbie asked Gary Barber if he would complete the review of all rental properties in Beachside Village with a list of the rentals, how each is managed, # bedrooms, # of people advertised it will accommodate and any pricing information that’s available.
Town Architect Audit
Debbie gave the Board an update on owner compliance. One owner was getting bids, another was starting the painting the following week and the third replied to the request for compliance by stating that “he will do this at his own discretion”. This owner, Harrison Yat, was in attendance. The board members had a lengthy conversation with Harrison, expressing their dissatisfaction with him and his partner as owners in the community. Gary Barber asked Harrison what Harrison thought about his house and Harrison stated that the ‘house could use a fresh coat of paint’. The board acknowledged that this property is solely an investment and that the profit motivation was inconsistent with neighborhood standards and that work needed to be done quickly. Harrison agreed to give a timeline within which he and his partner would comply with the TA requirements. John Price suggested that the Audit Report be send to all owners in the future.
Beach Cleaning Update
Debbie reported that she attended a meeting on July 23rd with the mayor, the old beach cleaning vendor, the new vendor and representatives from HOA’s on the west end. Everyone expressed dissatisfaction at the lack of ability to rake the beach. Debbie found out at this meeting that the Park Board permit to clean the beach only affected the area of the beach seaward of the 3’ contour line. The existing permit granted by the City of Galveston affects landward of the 3’ contour line. Debbie met with the surveyor who showed where the 3’ contour line exists along the beach and Debbie executed a contract with Sunrise Beach Services to clean the are landward of the 3’ contour line. Beach cleaning has resumed.
New Business:
There was no new business.
General Discussion:
There was some conversation about the warped boards on the dune walkovers and Debbie will get with Cypress Landscaping for a quote to remove and replace the warped boards. There was some discussion about drainage issues in the neighborhood and those will be addressed in the future when the TxDOT construction along FM3005 is completed because some of the silt fencing installed by TxDOT is hampering drainage. Bruce suggested that we look into the houses that aren’t lit at night and contact those owners and recommend that their properties come into compliance with this aspect of our Pattern Book.
