Minutes
The meeting was called to order at 10:07. The meeting was held at The Wine Next Door – 418 – 21st Street. In attendance were Harvey Michaels, Mark Stevenson, David Baze, Bruce Bardwell, Gary Barber and Fred Wagner. Also in attendance were Bruce, Debbie and Austin Reinhart. Steve Schulz, the HOA attorney was also in attendance. There was a quorum.
The Board reviewed the minutes from the April meeting. Fred Wagner moved to approve the minutes and David Baze seconded the motion. The minutes were approved. The financial statements for the 2nd quarter were also reviewed. Mark Stevenson moved to approve the financial statements and Harvey Michaels seconded the motion. The financial statements were approved.
Old Business:
Security Gate/GLO/City of Galveston – Very brief history: In 2013 there were a few night-time burglaries in the neighborhood and the Reinhart’s requested, on behalf of the HOA, to be granted a License to Use (LTU) to install security gates at the entrance to Beachside Village. The City conferred with the Texas General Land Office for their opinion and the GLO stated that it didn’t have an objection. The City granted the LTU to the HOA and the gatehouse and gates were built. In 2016 there was a turnover in staff and the GLO and the GLO questioned the approval process. The GLO had no records of the ‘approval’ because it disposes of communications after 6 months. All the HOA could show were minutes from the Planning Commission meeting where the City Attorney relayed that the GLO didn’t have any objections. This has not satisfied the GLO and it is insisting on the removal of the gates so that the public is not denied access to the beach – even though the gates are only closed between 9pm and 5am. The City is withholding accepting the infrastructure in Section 5 of Beachside Village until this is resolved. Several strategies were discussed at the meeting. Harvey suggested creating a global settlement strategy, it was suggested that we count cars that attempt to enter the neighborhood between 9pm-5am. Also discussed was working to get a City Council Representative for this area that’s more agreeable to neighborhood needs.
Splash Day Report
Splash Day was celebrated on June 15, 2019. We gathered in the large park on the western end of Beachside Village. The event was catered by Pappas Catering and we also had a Sno-Cone vendor. Approximately 175 people attended the event, representing approximately 55 properties. Pappas served 175 plates of food, we all enjoyed 103 sno-cones and we toured 3 homes as a group. The Board discussed the possibility of not walking through open houses because it’s so hot and instead suggested holding an open house event at another time of year.
Short Term Rentals
The revised Rental Regulations were filed at the Court House. Our neighborhood security is working with renters on Friday afternoons to meet the renters, review the regulations with the renters and asking for compliance. This is helping minimize issues over the weekend. We have a few owners who are particularly frustrated with the property at 11610 Beachside – this property routinely has too many cars and the renters are often very slow to move the cars that don’t fit on the property to the recommended overflow parking spaces on Sea Butterfly. The Board asked Debbie to invite the owners of 11610 Beachside to the next Board meeting to discuss their rental issues and the TA Audit issues with the Board. The security guard is encouraging owners to contact the property management for any property that’s not in compliance and to also call the owners, if they would like.
Town Architect Audit
Debbie reported that at this point most of the owners who had been sent letters concerning TA non-compliance issues had resolved their issues. A few owners were not in compliance yet and Debbie reported that she would follow up with those who hadn’t completed the required work.
Beach Cleaning Update
Debbie entered the HOA into the Parks Board Severe Seaweed Inundation Program at the request of the Board. The PB is reconsidering another vendor to use the USACE permit that the PB holds to allow the neighborhood beaches to be cleaned periodically. All Beach Maintenance Permits to rake the beaches expire on August 21, 2019 – the City is looking into extending these permits until such time that the issues can be further investigated and resolved. The new vendor, Sunrise Beach Cleaning, has provided a proposal to rake the beaches. If this is allowable, the Board gave Debbie their agreement for her to execute a beach raking contract with Sunrise.
Lastly, Debbie provided a copy of “Beachside Quick Facts” and a copy of the “Explanation of Budget Categories” – both documents that the Board had asked her to create. These documents can be shared with all owners and for new owners going forward.
Neighborhood improvements this quarter:
- All mat-style dune walkovers have been replaced,
- Finished the ‘fencing’ in Section 4 – attempt to prevent contractors and delivery trucks from crossing on lots,
- Purchased a police scanner for the security officer to monitor activities at the 8 Mile Road.
New Business:
There was no new business.
General Discussion:
The meeting was going long and David Baze needed us to wrap up the meeting so he could get ready to open his business. There wasn’t any general discussion.
